Terms and Conditions

In these conditions, ALMATH CRUCIBLES LTD is referred to as the Seller. Any customer purchasing goods from the Seller is referred to as the Purchaser.

How We Use Your Personal Information

1. Formation of Contract
1.1 Any order sent to the Seller by the Purchaser shall be accepted entirely at the Discretion ofthe Seller, and, ifso accepted, will only be accepted upon these conditions (hereafter referred to as the 'Conditions') 1.2
1.2 Each order which is so accepted shall constitute an individual legally binding contract between the Seller and the Purchaser and such contract is hereafter referred to in these Conditions as an 'Order'
1.3 These Conditions shall override any contrary different or additional terms or conditions (ifany) contained on or referred to in an order form or other documents or correspondence from the Purchaser, and no addition or alteration or substitution of these terms will bind the Seller or form part ofany Order unless they are expressly accepted in writing by a person authorised to sign on the Seller's behalf

2. Specification of Goods
Specification all goods supplied by the Seller shall be in accordance with the specifications or descriptions (if any) expressly listed or set out on the face ofthe quotation or Order. No other specification, descriptive material, written or oral representation, correspondence or statement, promotional or sales literature shall form part of or be incorporated by reference into the Order

3. Acceptance
The Purchaser shall be deemed to have accepted all goods upon their delivery by the Seller to the address specified in the Order

4. Delivery and Risk
4.1 Unless otherwise stated in the Order, the price quoted excludes delivery to the address specified in the Order
4.2 Any time or date for delivery given by the Seller is given by the Seller in good faith, but is an estimate only
4.3 Risk in the goods shall pass to the Purchaser upon delivery

5. Title and Payment
5.1 The Seller warrants that (except in relation to intellectual property rights of thirdparties as referred to in Condition 5.3) the Seller has good title to the goods and that (pursuant to s 12(3) ofthe Sale ofGoods Act 1979, or s 2(3) of the Supply of Goods and Services Act 1982, whichever Act applies to the Order) it will transfer such title as it may have in the goods to the Purchaser pursuant to Condition 5.5.
5.2 The Seller warrants that it is not aware ofany actual or alleged infringements of any intellectual property rights of third parties which relate to the goods other than those (if any) which the Seller has disclosed to the Purchaser prior to acceptance of Order.
5.3 The Seller shall have no liability to the Purchaser (other than as provided in Condition 10) in the event that the goods to be supplied under the Order infringe any intellectual property rights of a third party (including without limitation by reason of their possession, sale or use, whether alone or in association or combination with any other goods); the Seller gives no warranty that the goods to be supplied under the order will not infringe as aforesaid, and all conditions, warranties, stipulations or other statements whatsoever relating to such infringement or alleged infringement (if
any), whether express or implied, by statute, at common law or otherwise howsoever, are hereby excluded.
5.4 Unless otherwise stated in the Order, payment of the price of the goods comprised in each consignment delivered pursuant to an Order shall be due within 30 days of the date of the invoice. Payment after this time will carry interest at 2% over the minimum bank base lending rate of NATWEST Bank plc
5.5 Title to the goods comprised in each consignment shall not pass to the Purchaser until the Purchaser has paid their price to the Seller, but, even though title has not passed, the Seller shall be entitled to sue for their price once its payment has become due
5.6 The price quoted for any Order may vary between the date of acceptance and the date of delivery if the cost to the Seller of the raw materials used to produce the goods in the Order increases by more than 2% of their cost at the date of quotation.
5.7 All prices are exclusive of VAT.

6. Storage
If the Seller shall be unable, through circumstances beyond its control (including without limitation lack of shipping instructions from the Purchaser), to deliver the goods within 14 days after notification to the Purchaser or its agent that the goods are ready for delivery, the Seller shall be entitled to arrange storage on behalf of the Purchaser, whereupon delivery shall be deemed to have taken place, all risk in the goods shall pass to the Purchaser, and delivery to the Purchaser of the relevant warehouse receipt shall be deemed to be delivery of the goods for the purposes of Condition 4. All charges incurred by the Seller for storage or insurance shall be paid by the Purchaser within 30 days of submission of an invoice.

7. Damage in transit
The Seller will replace free of charge any goods proved to the Seller's satisfaction to have been damaged in transit provided that within 24 hours after delivery both the Seller and the carriers have received from the Purchasers notification in writing of the occurrence of the damage and also, if and so far as practicable, of its nature and extent

8. Force majeure
8.1 The Seller shall not be under any liability for any failure to perform any of its obligations under the Order due to Force Majeure. Following notification by the Seller to the Purchaser of such cause, the Seller shall be allowed a reasonable
extension of time for the performance of its obligations
8.2 For the purposes of this Condition. 'Force Majeure' means fire, explosion, flood, lightning, Act of God, act of terrorism, war, rebellion, riot, sabotage, or official strike or similar official labour dispute, or events or circumstances outside the reasonable control of the party affected thereby.

9. Guarantee
9.1 For goods which are manufactured by the Seller or which bear one of the Seller's trade marks, the Seller grants the following guarantee:
9.1.1 The Seller shall free of charge either repair or, at its option, replace defective goods where the defects appear under proper use within 30 days from the date of delivery, PROVIDED THAT:

9.1.1.1 notice in writing of the defects complained of shall be given to the Seller upon their appearance, and
9.1.1.2 such defects shall be found to have arisen from the Seller's faulty design, workmanship or materials, and
9.1.1.3 the defective goods shall be returned to the Seller's premises at the Purchaser's expense if so requested by the Seller
9.1.2 Any repaired or replaced goods shall be redelivered by the Seller free of charge to the original point of delivery but otherwise in accordance with and subject to these Conditions of Sale
9.1.3 Alternatively to Condition 9.1.1, the Seller shall be entitled at its absolute discretion to refund the price of the defective goods in the event that such price shall already have been paid by the Purchaser to the Seller, or, if such price has not been so paid, to relieve the Purchaser of all obligation to pay the same by the issue of a credit note in favour of the Purchaser in the amount of such price
9.2 In respect of all goods manufactured and supplied to the Seller by third parties the Seller will pass on to the Purchaser (in so far as possible) the benefit of any warranty given to the Seller by such third parties and will (on request) supply to the Purchaser details of the terms and conditions of such warranty and copies of any relevant product information sheets, technical data sheets or product leaflets issued by such third parties and the Purchaser shall be solely responsible to the entire exclusion of the Seller for complying with all of these
9.3 The Seller's liability under this Condition shall be to the exclusion of all other liability to the Purchaser whether contractual, tortious or otherwise for defects in the goods or for any loss or damage to or caused by the goods, and (subject to Condition 14) all other conditions, warranties, stipulations or other statements whatsoever concerning the goods, whether express or implied, by statute, at common law or otherwise howsoever, are hereby excluded; in particular (but without limitation of the foregoing) the Seller grants no warranties regarding the fitness for purpose,
performance, use, nature or merchantable quality of the goods, whether express or implied, by statute, at common law or otherwise howsoever 10.Intellectual property rights

 

10. Ownership
All tools and jigs, moulds or other equipment used in the manufacture of goods the subject of the Order shall at all times remain the property of the Seller, even when the Purchaser has paid for them.

11. Confidentiality
Both the Seller and the Purchaser shall each keep confidential and shall not without the prior consent in writing of the other disclose to any third party any technical or commercial information which it has acquired from the other as a result of discussions, negotiations and other communications between them relating to the goods and the Order

12. Economic loss
Subject to Condition 14, and notwithstanding anything contained in these Conditions (other than Condition 14) or the Order, in no circumstances shall the Seller be liable, in contract, tort (including negligence or breach of statutory duty) or otherwise howsoever, and whatever the cause thereof, (i) for any loss of profit, business, contracts, revenues, or anticipated savings, or (ii) for any special indirect or consequential damage of any nature whatsoever.

 

13. Limitation of liability
Subject to Condition 14, and notwithstanding anything contained in these Conditions (other than Condition 14) or the Order, the Seller's liability to the Purchaser in respect of the Order, in contract, tort (including negligence or breach of statutory duty) or howsoever otherwise arising, shall be limited to the price of the goods specified in the Order.

14. Unfair Contract Terms Act 1977
14.1 If and to the extent that s 6 and/or 7(3A) of the Unfair Contract Terms Act 1977 applies to the Order, no provision of these terms and conditions shall operate or be construed to operate so as to exclude or restrict the liability of the Seller for breach of the express warranties contained in Condition 5, or for breach of the applicable warranties as to title and quiet possession implied into the terms and conditions of the Order by s 12(3) of the Sale of Goods Act 1979, or s 2(3) of the Supply of Goods and Services Act 1982, whichever Act applies to the Order
14.2 Where the Purchaser is a natural person and if and to the extent that s 2(1) of the Unfair Contract Terms Act 1977 applies to the Order, nothing in these terms and conditions shall operate or be construed to operate so as to exclude or restrict the liability of the Seller for death or personal injury caused to the Purchaser by reason of the negligence of the Seller or of its servants, employees or agents

15. Exclusion of rights of third parties
These conditions are not made for the benefit of, nor shall any of their provisions be enforceable by, any person other than the parties to this Agreement and their respective successors and permitted assignees.

16. Applicable law
The Order shall be considered a contract made in England and shall be governed in all respects by the law of England and the parties agree to submit to the non-exclusive jurisdiction of the English Courts.

She has a Romania st dog called Suki, and she loves taking Suki for long walks. Her favourite food is chocolate – there is usually a supply of chocolate digestives on Jacquis’ desk!

Annie works in marketing and admin, and her job involves writing quotes, managing the social media, and writing our e-shots (and doing stuff like this!).

She started at Almath in October 2023.

She loves walking her dog, baking, and travelling. Annie is half American and has family across the USA. Before Almath, she worked as a gymnastics coach in New York. Her favourite food is ice cream or fruit, and her favourite thing to bake is chocolate chip cookies!

Casting Technician
Laura is a casting technician, and her day-to-day work involves casting, mould making, slip making and finishing. She started working at Almath in 2009, and her favourite thing about working here is the people (and the big tea urn!).

She loves Japanese food and prosecco, and she has 2 cats, 2 rabbits and 2 kids – clearly has a thing for the 2s!

Deren

Ceramic Technician
Deren is a ceramics technician, and a usual workday for him would be to look through orders, and work through the most important ones. He also designs and machines parts and uses the isostatic press.

He began working at Almath in March 2023, and before this he worked in landscaping.

His favourite food is oriental, favourite drink is apple juice, and he has a betta fish called noodle. He was born in Mauritius and has a twin brother called Daren, and a sister called Sharone.

Master Caster
Sandra works in casting, and her job involves making slip, slip casting, finishing, and organising the production of ongoing orders. She started working at Almath 16 years ago and enjoys how satisfying the process of casting is. She loves most foods that start with a C – such as cheese, chocolate, cake, crisps etc – don’t we all!

She likes scaring Deren (our ceramics technician), and her and Tianna had a great gotcha moment when she faked a heart attack after Deren tried to scare her, he fell for it and his face was worth it! She enjoys socialising with friends, gardening, and doing crafts.

Maggie

Office Manager
Maggie is our office manager, and her job involves invoicing clients, updating customers on order progress, and ensuring all bills are paid promptly. She’s often the friendly voice on the end of the phone! She started at Almath in January 2017, and has been a key part of the team ever since. Maggie loves long country walks, Ipswich town football club and a Chinese with a good glass of wine! Before Almath, she worked in a bank for 30 years, giving her great experience in finance. A fun fact is that she was nicknamed Jumbo by the nurses when she was first born, being a large baby at 10 ½ lbs!

Jody is our apprentice mechanist, and he is responsible for programming, setting up and running the CNC machinery. He started in September 2021 as a slip caster, and despite finding it difficult at first the more he practiced the skills developed, and he now loves it! His favourite part of working here is that everyone is always in high spirits. He loves ramen, he spends a lot of time at the gym and if it’s sunny you can always find him in a beer garden!

Arek

Ceramic Technician
Arek is one of our ceramic technicians, and his job involves loading and unloading furnaces, quality control, preparing products (grinding, cutting, measuring), packing and sending products to customers and furnace checking and repairing. He started working at Almath in 2015, and his favourite drink is coffee. He enjoys growing fruit and vegetables, cycling, playing squash and spending time with family.
Dr Yu Yu

Dr. Yu Yu

Materials Researcher
Yu is our material researcher, and her role includes creating advanced ceramic products with exceptional mechanical or conductive properties for use in a range of industries. She started at Almath in March 2022, and she likes the friendly atmosphere!

She has been conducting research on ceramic materials since 2017 in university, and her favourite food is spicy snail rice noodles. She shares a funny story about work… once, the flange end of the tube furnace shot into the wall, leaving a hole, all because of a blocked valve and a never-ending stream of Argon. Now there are three holes in that wall, but it’s still standing….
Dr Tim

Dr. Tim

Materials Processing Director
Tim is our material processing director, and he works with the team to develop new materials and processes, in addition to working with customers to develop ceramic components for them.

He started working at Almath in March 2024, and he enjoys making crucibles and components that enable customers to do their developmental work. His favourite food is a meatball subway, and he is the men’s & mixed captain for his tennis club. Tim is also training for his first hydrox event in November.

Fun fact – he is allergic to tigers!

Danny

Head of Engineering
Danny works in CAD design, CNC programming, wire cutting, ceramic fabrication, turning and milling aluminium laser cutting and 3D printing (a bit of everything!).

He has worked at Almath for 8 years now, and his favourite part of his job is problem solving and sharing skills with colleagues. One time at work he spent the entire day trying to fix the dd CNC lathe, only to find out it was ‘broken’ because the emergency stop button was on! Danny’s favourite drink is Captain Morgan tiki rum, he has a Siamese fighting fish called Kratos, and he’s piloted and done somersaults in a Tudor aeroplane! How cool!

Quality Control Manager
Elliot is our quality control manager, and everyday is different for him, as it depends on what Almath are producing at the time and what is due to be dispatched.

He joined the team in March 2023, and was an instant fit, as he had worked with our director Michael many times in his previous job. Elliot has 28 years of experience working in the laser industry and has helped Almath to further develop and expand our laser services to offer a wider range of services.

He has around 200 giant African land snails, and is a founding member of the band – Isle ‘ave a Shanty – we recommend listening! He has also sung and recorded an album at the legendary Abbey Road studios in London.

Business Development Director
Ian is our business development director, and his job involves working with customers to find solutions to their requirements, ensuring that our website is up-to-date with our latest products and services and looking for new opportunities where our products can be used.

He started working at Almath in August 2022, and he enjoys working as part of a dynamic and flexible team. He says that “As Almath are relatively small, it means we can adapt quickly to meet customer requirements – it is always great to receive feedback from our customers telling us how we have helped solve their problems!”.

He holds a degree in Materials Science & Engineering, and over 20 years’ experience in the ceramics & glass sector. He loves Italian food, has a dog called ‘kinda’ and enjoys running. Fun fact – he met his wife on an Italian TV show!
Michael Misson

Director
Michael is our director, and his job involves overseeing the day-to-day operations of the business, and doing a bit of everything!

He has been the director of Almath for the past 15 years, but worked within Almath with his father and other family members previous to this. Michael grew up in Suffolk, but has lived in the USA and the Netherlands, and loves travelling and experiencing new cultures and places. Prior to working at Almath, Michael worked in mechanical engineering, aircraft fabrication and as a special needs nurse. He loves red wine, electric cars, motorcycles, and boats!

In January, he spent 3 weeks sailing from Tenerife back to Portsmouth, and he enjoys sailing at any chance he gets! Michael is very sociable, and he likes the more challenging items we produce, and working with the engineering and production team to figure out how to overcome challenges and innovate to further improve and expand our product range. He has 2 sons, Owen and Oscar and is hoping one of his sons will send him home from work for good one day (eventually), and take over, so Almath can remain a family owned and independent business.
